Thai Police Bust Fake Cosmetics; FDA Approval Now Vital

Recently, the Consumer Protection Police Division (CCPD) of Thailand raided an illegal cosmetics factory in the Chum Phae District of Khon Kaen Province. Authorities seized more than 40,000 unauthorized cosmetics on the spot, valued at approximately two million Thai baht. They discovered that someone had produced these products through illegal channels and sold them to stores in multiple provinces in the northeastern region without FDA approval.

Details of the operation.

After receiving a tip-off, the police tracked down a private residence and found that criminals had transformed it into an illegal cosmetics production base. During the raid, the law enforcement officers discovered multiple machines used for label printing and packaging, as well as several workers who were working on the spot.

The person in charge of the site is Ms. Janiya, 23 years old. She admitted on the scene that she managed and operated the factory. In total, the police seized items from 38 production lines in the factory, covering multiple types of cosmetics. Authorities have charged Ms. Janiya with producing and selling unauthorized, unsafe, and counterfeit cosmetics.

This illegal cosmetics incident once again reminds enterprises and consumers that legal cosmetics must comply with the relevant laws and regulations of the Thai Food and Drug Administration (Thai FDA). The following are the key requirements for legal cosmetics:

1. Registration and Licensing

Depending on the functions and uses of the cosmetics, businesses must apply for different types of licenses from the Thai FDA.

  • Ordinary cosmetics: They can be sold after submitting the ingredient report.
  • Controlled cosmetics: Approval and registration from the FDA are required, such as hair dyes.
  • Special cosmetics: For example, sunscreen products and whitening products need to undergo strict examination and registration.

The registration procedures include:

  • Submitting the product formula, ingredients, labels and samples for review.
  • For imported cosmetics, the certificate of origin of the producing country, the ingredient list and the manufacturer’s qualifications need to be provided.
2. Labeling and Packaging Specifications

The manufacturer must label the following information in Thai on legal cosmetics:

  • Product name, ingredient list, net content.
  • Production date or expiration date, the names and addresses of the manufacturer and the importer.
  • Lot number and necessary warning instructions (if applicable).
3. Ingredient Safety and Compliance
  • Products must not contain ingredients prohibited by the Thai FDA (such as lead and mercury).
  • Data supporting the safety and efficacy of active ingredients need to be provided.
4. GMP Production Standards
  • The production factory must comply with GMP (Good Manufacturing Practice) and have a clear production process and quality control system.
  • Storage conditions should maintain appropriate temperature and humidity to ensure product quality.
5. Advertising and Sales Compliance
  • The promotional content must be truthful, and false exaggeration of efficacy is prohibited.
  • The advertisements for certain functional products need to be approved by the FDA before being released.

Those who produce or sell non-compliant cosmetics may face the following consequences:

  • Heavy fines: Offenders need to bear high financial compensation.
  • Product confiscation: All illegal cosmetics and related production equipment will be seized.
  • Legal liability: The persons involved may be prosecuted and even sentenced to prison.

Counterfeit and unlicensed beauty products may pose a serious threat to consumers’ health. Buyers must exercise extra caution when purchasing goods through online channels.
