Application conditions for a work permit in Thailand

1.Visa Requirements
Foreigners applying for a work permit must hold a valid Non-Immigrant Visa, among which the most common one is the Non-B Visa. You cannot apply for a work permit with a tourist visa or a visa on arrival. Therefore, before entering the country, it is necessary to ensure that the visa type meets the application eligibility. Also, after arriving in Thailand, it is necessary to ensure this as well.

2.Proof of Qualification
The applicant needs to provide academic certificates. They also need to provide professional qualification certificates or other relevant documents. These documents should be related to the work they will be engaged in. The purpose is to prove their ability to perform the position. In some industries, additional professional certifications or proof of work experience may also be required.

3.Employer Guarantee
Applying for a work permit must be guaranteed by a Thai employer. The employer has two main tasks. First, the employer needs to provide the applicant with a formal labor contract. Second, the employer needs to submit relevant company documents. Examples of these documents include the company’s registration certificate and tax records. Application Process of the Work Permit in Thailand

1.Submitting the Application
The applicant or employer must submit a complete application to the Department of Employment, which handles foreign work permits in Thailand.

2.Document Review
The department reviews qualifications, visa type, employer credentials, and materials for work permit approval. If there are any omissions or issues, supplementary materials may be required or further verification may be carried out.

3.Approval and Issuance
Once approved, the authority issues the Work Permit, allowing legal work in Thailand. The applicant must collect it in person and carry it during work.

Processing Duration: The entire application process usually takes no more than 15 working days. The processing time varies based on material completeness, nationality, and company qualifications. To ensure approval, prepare all materials in advance and follow the requirements strictly.

I. Materials to be Prepared by the Applicant

1.Official Application Form
Complete the form with a job description, workplace map, and hiring reason to justify employing a foreign worker.

2.Passport (with a validity period of more than 6 months)
The applicant needs to sign and photocopy all pages as proof of identity and entry and exit records.

3.English or Thai Resume (CV/Resume)
It is necessary to list in detail the educational background, work experience, skills, etc., to ensure that they are relevant to the applied position.

4.Proof of Academic Qualification (Needs to be Notarized and Translated)
The applicant needs to translate the academic certificate into English or Thai and have it notarized. This certificate serves as an important basis for the qualification review.

5.Health Examination Certificate (Issued by a hospital recognized by Thailand, with a validity period of 6 months) It needs to include blood type information and prove that the applicant has no following diseases: Leprosy, Acute Pulmonary Tuberculosis, Drug Addiction, Elephantiasis (Filariasis), Tertiary Syphilis

6.Six Recent Photos (White background, 4×6 cm)
Photos must be taken within six months and clearly show the applicant’s current appearance.

7.Relevant Materials of the Agent (If the application is not submitted by the applicant himself/herself)
When an agent handles the application, the agent needs to provide a 10 – baht revenue stamp and submit a formal power of attorney.

II. Materials to be Provided by the Company (Employer)

1.Company’s Business Registration Certificate
The business registration department issues it. It proves that the company is legally registered and includes:
Company name, names of directors, registered capital

2.Certified Shareholder Register
The business registration department certifies it and uses it to confirm the company’s equity structure and organizational structure.

3.Factory License (if applicable)
If the company is involved in manufacturing or factory production operations, the company needs to provide this license to prove its legal operation.

4.Value Added Tax (VAT) Registration Certificate
It proves that the company has registered for Value Added Tax (VAT) and complies with Thai tax regulations.

5.Withholding Tax Certificate (for renewal)
